If one parent is not living up to the official court order, you can seek an enforcement to make sure the order is followed. Enforcement is available for violations of both child support and access. We handle both types of claims:

  • Child and Spousal Support: If you are not receiving child support or spousal support payments, or you are not receiving them in a timely manner, we can help you set things right.
  • Access: If your co-parent is not giving you the fair parenting time you are allowed by law under your custody and visitation plan, you can take action to protect your rights.

The first thing we will do is send a letter to the other party, letting them know that you are willing to take action and asking if they would like to work out the situation. If we do not receive an appropriate response, we will file a motion with the court. Once in court, we will explain our case to the judge and ask for a change, which can lead to a modification.

If this is the first instance of a problem, the court will be more lenient. In the case of child support, they will ask that all past due support is paid, which can usually be done over time. If this is part of a continuing problem, the court has the power to take stronger action, including ordering jail time.

In support cases, wage garnishment is another option. Whether it is a case of initial support, modification, or arrears, if the party in question is employed, the court almost always orders wage garnishment. In effect, this takes away the ability to stop paying, and has reduced the number of repeat cases for the Texas courts.
