Galveston Texas Modification Lawyer
Texas City Child and Spousal Support Attorney
As your life changes, your child custody and support plans should be able to change with it. If there has been a major change to the circumstances that precluded your first plan, you can get a modification to accurately reflect your current situation. At the Galveston and Seabrook Law Offices of Susan M. Edmonson, we help families modify a variety of court orders, including child support, spousal support, child custody, and visitation.
Modification · Child Support · Spousal Support
In Texas, you are allowed to modify all types of plans, from child support to terms of access to children. If both parties see the need for and are willing to attain a modification, the process is fairly simple. If only one party seeks to modify the agreement, we must be able to demonstrate a material and substantial change in circumstances before the court will consider modifications.
When you walk into our Galveston or Seabrook offices, one of the first things our lawyers will do is look at your plan and determine whether there has been a significant change. Major changes that should be taken into account can include job loss, remarriage, or anything else that has led to a major change in financial circumstances.
Child Support Modifications and the New Law
In September of 2007 there was a change in Texas law which altered the specific cap for child support. Many people are interested in seeking modifications under the new law. In Texas, child support is determined on a percentage basis of net income, based on the number of children.
Under the old law, the monthly income from which child support could be extracted was capped at $6,000. With the recent law change, the cap has been expanded to $7,500. Paying parents making over six thousand dollars a month are now expected to pay more to child support. This has changed the cap from $1,200 a month to $1,500 a month for a single child.
